Судебная система Ниуэ представляет собой трехуровневую судебную систему, установленную Конституционным законом Ниуэ в островном государстве Ниуэ . В его состав входят Высокий суд, обладающий юрисдикцией первой инстанции по рассмотрению всех уголовных , гражданских и земельных дел, Апелляционный суд, обладающий апелляционной гражданской и уголовной юрисдикцией, и Тайный совет в Англии. Судьи интерпретируют закон в соответствии с Конституцией Ниуэ, и если они определяют, что закон нарушает Конституцию, Конституция имеет преимущественную силу. система общего права В судебной системе используется , а Доктрина прецедента гарантирует, что суды низшей инстанции следуют прецеденту судов высшей инстанции. Гражданские и уголовные суды действуют в рамках состязательной правовой системы , тогда как земельные суды действуют в рамках следственной правовой системы .

Высокий суд

Высокий суд Ниуэ обладает юрисдикцией первой инстанции по уголовным, гражданским и земельным делам. Суд разделен на три отделения; уголовный отдел, гражданский отдел и земельный отдел. Кроме того, в нем есть три типа чиновников; Судьи, комиссары и мировые судьи. Основное различие между ними заключается в юрисдикции . Еще одним заметным отличием является возможность стать главным судьей, что является полномочиями только судьи, и что судьи имеют право на повторное слушание .

Нынешний главный судья - Крейг Коксхед . ^[1] Главный судья избирается генерал-губернатором Новой Зеландии по рекомендации кабинета министров Ниуэ . ^[2] По состоянию на 2014 год ^[update]Судьями являются судья Уилсон Айзек, главный судья Коксхед и судья Сара Ривз. Комиссарами по гражданским и уголовным делам являются г-н Десмонд Хипа, г-жа Сифаоле Иоане и г-жа Таумалуа Джексон. Уполномоченными по земле являются г-жа Ревматик Алапаки, г-жа Майхето Хекау, г-н Робин Хекау, г-н Хейл Икитуле, г-жа Леливийка Лиумаихетау и г-н Саукия Тукуитонга. В уголовных процессах применяется идея невиновности, пока вина не доказана , и бремя доказывания лежит на стороне обвинения. В 2014 году было возбуждено 109 уголовных дел, средний срок рассмотрения дел составил 54 дня. ^[3]

Земельный суд и юрисдикция

Комиссары и судьи обладают юрисдикцией Земельного суда. ^[7] В 2013 году было возбуждено 260 дел, разрешено 150, средняя продолжительность рассмотрения дела составила 72 дня. ^[3] Справа представлена схема структуры и производства дела в Земельном суде.

Апелляционный суд

Апелляционный суд является апелляционным судом , который может рассматривать апелляции на основании разрешения Высокого суда на рассмотрение дел чрезвычайной важности, если Высокий суд подтверждает, что это связано с толкованием конституции, или когда Апелляционный суд предоставляет специальное разрешение на подачу апелляции. . В уголовной юрисдикции лицо, осужденное за уголовное преступление, может подать апелляционную жалобу, если оно приговорено к смертной казни , пожизненному заключению или к штрафу или лишению свободы, не установленному законом. ^[5]^[8] Апелляционный суд собирается примерно раз в три года. Очень немногие дела обжалуются в Апелляционном суде, часто менее трех в год, и в среднем очень небольшое количество дел отменяется. ^[3]

Государь в совете

Суверенный совет официально является высшей судебной инстанцией Ниуэ. Это король Соединенного Королевства , действующий по рекомендации и по рекомендации Судебного комитета Тайного совета . Потерпевшая сторона может подать апелляцию в Апелляционный суд, и решение о Его Величества том, принять ли дело к рассмотрению, остается на усмотрение . На самом деле эта функция принадлежит Судебному комитету Тайного совета , который является высшим судом судебной системы Ниуэ. ^[5] Судебный комитет еще не рассматривал дела Ниуэ, хотя они рассмотрели множество дел с близлежащих островов Кука . ^[9]^[10]
